Orchid’s Letter for Breaking Lease Early

Somewhereville Property Management

January 1, 2020

Dear Somewhereville Properties

I am currently a tenant at 111 Dandelion Street. I am writing to request a reasonable accommodation as a person with disabilities under the Fair Housing Act.

Accommodation request:

I am requesting to add a clause to my current and future lease allowing me to terminate the lease when needed with 30 days notice, and to grant an exception to your re-renting policy.

Or

I am requesting an early termination of my lease with a move out date of March 1, 2020.

Reason for Request:

I appreciate being able to live at Somewhereville Properties this year, and am grateful for the work you have done to provide affordable housing to low-income families in our community.

Sample Disability-Related Reasons

I also have specific disability needs which make finding suitable housing far more difficult and eliminates many options. I have very few options for apartments that will meet my disability needs and I cannot control the timing of when such an apartment might become available or how much lead time I will be given for moving in.

For these reasons, I am not able to find new housing in a narrow timeframe. This accommodation will allow me to secure new housing in the time frame I need without becoming at risk for homelessness or further compromising my health.

Financial Penalties

I am requesting that there be no fees, re-renting charges, or financial penalties for granting this accommodation or for early lease termination. This request is based on the HUD policy which states, “Housing providers may not require persons with disabilities to pay extra fees or deposits as a condition of receiving a reasonable accommodation.” (JOINT STATEMENT OF THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AND THE DEPARTMENT OF JUSTICE REASONABLE ACCOMMODATIONS UNDER THE FAIR HOUSING ACT)

This accommodation is made in accordance with HUD FHEO policies on Reasonable Accommodations and Modifications, which state that: “Federal nondiscrimination laws require housing providers to grant requests for reasonable accommodations and modifications in housing, programs, and activities.”

I am attaching a third party verification to support this request.

Thank you for your time and consideration.

Best Wishes,
Orchid Flowers
