
When Sundew was offered a housing voucher in another state, she was unable to move her disabled child to the new location. The Housing Authority told her that she must relocate to the new area for at least 12 months before moving away, and no exceptions would be made.
Sundew sent the Housing Authority a reasonable accommodation request, along with a letter from her child’s doctor recommending that her child not be moved away from current specialized educational and medical services.
This type of accommodation request is not always approved. However, Sundew was fortunate. The Housing Authority approved her request and allowed her to transfer her voucher to her current area without having to move first.
Sundew and her family were able to keep the voucher without having to move.
Here’s a copy of her doctor’s letter:
Dear XYZ Housing Authority,
L___________ is my patient, and has been under my care for the past three years. She meets the definition of disability under the Americans with Disabilities Act, the Fair Housing Act, and the Rehabilitation Act of 1973.
L___________ has a condition that requires specialized medical treatment. She is currently receiving treatment through the XYZ program at XZY Children’s Hospital. In addition, she is in a specialized school setting at XYZ school.
In my opinion as her physician, it is medically-necessary for L___________ to continue the treatments and services available at her current location. L______ is medically fragile. Relocating and stopping treatment could be dangerous for her condition. If she relocates to another area that does not have the specialized services available at XYZ Children’s Hospital, this could place her health at risk.
To address her disability needs, she requires continued access to the specialized medical care that is available at XYZ Children’s Hospital, as well as stability and consistency in her treatment, practitioners, and school setting.
