Long Term Disability is disability offered through your employer’s insurance. Some people also purchase their own private disability plans.

This type of disability is different than Social Security disability, and you need a different kind of lawyer! Instead of looking for lawyers listed as “disability lawyers,” try looking for a lawyer who specializes in employment law or “ERISA law”.

Where to Find Lawyers

💠 The NELA website includes a list of lawyers who help with employment law.

💠 You can also search for ERISA lawyers on: AVVO. Type in “erisa” and the name of your area.

💠  Tip: Some ERISA lawyers will work with you from any state. You don’t need to limit yourself to just your local area.

Myalgic Encephalomyelitis and Chronic Fatigue Syndrome

Lawyers recommended by readers with ME and CFS cases:

💠  Stuart Sandhaus – Recommended by multiple readers, this is the lawyer Dahlia used:  Dahlia Proves She’s Not Mental

💠 Barbara Comerford – Here’s a story about an ME/CFS case that was won by Barbara Comerford’s law office. And here is an article she wrote on ME/CFS and Long Term Disability

💠 Kantor and Kantor – Here’s a podcast interview with Andrew Kantor: Navigating the Disability Process for those with ME/CFS

ERISA lawyers can be expensive and some will take a part of your check every month for the rest of your life. Read your contract carefully and make thoughtful decisions about how much to pay a lawyer.

  1. Thank you for being so informative.
I lost my home in one of the recent northern California wild fires. PG&E was at fault. I am in a lawsuit against PG&E and waiting on a fairly large settlement.
Here’s my question: I am on SSDI and do not want my benefits and medicare to be negatively effected and/or try minimize the effect of my settlement money. I also have a payee who is unsure what to do. Who should we be talking to? We tried finding info online at the SSDI website as well as various other places. Thanking you in advance
